TERMS AND CONDITIONS "Soundboard Online"

Effective Date: 01/08/2025 Last updated: 22/10/2026 Welcome to Soundboard Online (“we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of Soundboard Online: the mobile application, the desktop application, and the website at online-soundboard.com (together, the “App”), a platform for uploading, sharing, and organizing audio and video content. By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App. 1. ELIGIBILITY You must be at least 16 years old to use Soundboard Online. By using the App, you confirm that you meet this age requirement and that you have the legal capacity to enter into these Terms. If we determine, or have reasonable grounds to believe, that a user is under 16, we may remove their content and suspend or terminate their account without notice. 2. ACCOUNT REGISTRATION 2.1. To access certain features of the App, you must register for an account. You agree to provide accurate, current, and complete information and to update it as necessary. 2.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. 3. UPLOADS 3.1. You may upload, post, or otherwise transmit audio and video content (“Uploads”) via the App. 3.2. You retain all ownership rights to your Uploads. However, by uploading content to the App, you grant Soundboard Online a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, distribute, display, and perform the content for the purpose of operating and promoting the App. 3.3. You represent and warrant that you have the rights to upload the content and that it does not violate any law or the rights of any third party. 3.4. If your Upload uses copyrighted material, you must have the rights to use it. Uploads are removed when we receive a valid takedown notice (section 4), and accounts that repeatedly infringe are terminated. 4. COPYRIGHT AND TAKEDOWN REQUESTS 4.1. Soundboard Online hosts content uploaded by its users. Uploads pass automated checks but are not reviewed by a person before they are published. We respect the rights of copyright owners and respond to notices of alleged infringement, including notices under the US Digital Millennium Copyright Act (DMCA). 4.2. If you are a copyright owner, or authorised to act for one, and believe that an Upload infringes your rights, send a takedown notice to [email protected] with "Copyright" in the subject line. To be acted on, a notice must include: - the copyrighted work you believe is infringed (a title, or a link to where it is published); - the link to the Upload on the website (for example https://online-soundboard.com/sound/...) or, in the mobile application, the name of the sound and the username of the uploader, so that we can find it; - your name, address and email address and, if you act for someone else, who you represent; - a statement that you have a good-faith belief that the use of the work is not authorised by the copyright owner, its agent, or the law; - a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf; and - your physical or electronic signature. 4.3. When we receive a complete notice, we promptly remove or disable access to the Upload and inform the user who uploaded it, including who sent the notice. 4.4. If your Upload was removed and you believe this was a mistake or a misidentification, you may send a counter-notice to the same address with: the link to or name of the removed Upload; your name, address and email address; a statement under penalty of perjury that you have a good-faith belief the content was removed by mistake or misidentification; your consent to the jurisdiction of the courts of your place of residence (for US residents, the federal district court for your district); and your signature. We forward counter-notices to the party who sent the original notice and may restore the Upload 10 to 14 business days later unless that party tells us they have filed a court action against you. 4.5. We terminate the accounts of users who repeatedly infringe copyright, and we may remove an Upload at our own discretion where infringement is apparent, without waiting for a notice. 4.6. Knowingly sending a false notice or counter-notice can make you liable for damages, including costs and legal fees. Use this process only for content you have a genuine right to claim. 4.7. The Report option inside the App (reason: "Copyright") also flags an Upload to us. A report helps us find the content; a notice with the details above is what lets us act on a rights claim. 5. USER PROFILES 5.1. You may be allowed to upload a profile avatar or profile image for your account. 5.2. Your avatar must not contain sexual content, nudity, gore, graphic violence, or other content that we consider offensive, abusive, or inappropriate. 5.3. We reserve the right to remove or replace any avatar that violates these Terms or that we consider inappropriate for the App. Repeated violations may result in suspension or termination of your account. 5.4. By uploading an avatar, you confirm that you have the necessary rights to use that image. 5.5. Your avatar may be stored and processed by us as part of your account information in order to operate the App and display your profile to you and other users. 5.6. Your profile also includes text fields such as your username, display name, and profile bio (“Profile Information”). All rules in these Terms that apply to Uploads and avatars apply equally to Profile Information. 5.7. Your Profile Information must not contain: - sexual, obscene, or suggestive content, or invitations or solicitations of a sexual or romantic nature directed at other users; - contact details or links intended to establish private, off-App communication with other users — including phone numbers, email addresses, and contact or messaging links for services such as GroupMe, WhatsApp, Telegram, or Snapchat; - advertising, promotions, or solicitation of commercial services; - impersonation of any person, brand, or entity; or - personal information of any other person. Links or handles for public social profiles (for example a TikTok or YouTube channel) are permitted. However, we may remove any external link or handle at our discretion, in particular where it appears alongside solicitation or is used to target other users. 5.8. We may remove, edit, or reset any Profile Information that violates these Terms or that we consider inappropriate, without prior notice. Repeated violations may result in suspension or termination of your account. 6. PROHIBITED CONDUCT To keep Soundboard Online safe and thematically appropriate, you agree not to post spam or other off-topic content. You agree not to: - Upload or share content that is illegal, obscene, pornographic, sexually explicit, defamatory, infringing, harassing, or otherwise objectionable. - Upload or share content that depicts, features, or is created by a minor (a person under 16), including any content that sexualizes, exploits, or endangers a minor. - Upload avatars or other profile images containing sexual content, nudity, gore, or graphic violence. - Include in your username, profile bio, or other profile fields any sexual or romantic solicitation, or any contact details or links intended to establish private, off-App communication with other users (such as phone numbers, email addresses, or messaging-service contact links). - Impersonate any person or entity, or misrepresent your affiliation with any person or entity. - Post or share another person’s personal information without their consent. - Use the App for any unauthorized or unlawful purpose. - Attempt to gain unauthorized access to other users’ accounts or the App’s systems. - Engage in any activity that could harm, disable, overburden, or impair the App. - Access the App by automated means (bots, scrapers, or crawlers other than public search engines), or download content in bulk. 7. CONTENT MONITORING Every Upload passes through automated checks when it is published, and we may run further checks at any time afterwards. These checks can delay, block or remove an Upload and can suspend an account. They are not a review by a person, and no check catches everything, so we also rely on user reports and on the notices described in section 4. We remove content that violates these Terms when our checks, a report or a notice brings it to our attention, and we act on reports promptly. If your Upload was blocked or removed and you believe this was a mistake, contact us at [email protected]. We may also remove any content, including Uploads, avatars, and Profile Information, that we deem inappropriate, and we may suspend or terminate your account for violations of these Terms. In particular, where we determine or have reasonable grounds to believe that content depicts a minor (a person under 16), or that content was created or posted by a person under 16, we may remove that content and suspend or terminate the associated account without notice. 8. PRIVACY Your use of the App is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information, including profile information such as avatars where applicable. 9. ADVERTISING The App is supported by advertising served by third parties such as Google (AdMob in the mobile application, AdSense on the website). Advertisers and advertising networks are not affiliated with Soundboard Online, and we are not responsible for the content of advertisements or for the websites they link to. You agree not to interfere with the display of advertisements and not to generate clicks or impressions on them by automated or fraudulent means. Our Privacy Policy describes how advertising uses data and how you can control it. 10. INTELLECTUAL PROPERTY All intellectual property rights in the App, including its design, features, and functionality, are owned by or licensed to Soundboard Online. You may not use any part of the App for commercial purposes without our prior written consent. 11. TERMINATION We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or to us. 12. MODIFICATIONS TO TERMS We may update these Terms from time to time. We will notify you of material changes, and your continued use of the App after such changes constitutes your acceptance of the new Terms. 13.
